Receipts not ratification of non-existent contract for sale of land

NSW Court of Appeal says daughter did not contract for mother.

The NSW Court of Appeal has held that a daughter's discussing the sale of her mother's land with her former husband was not the contractual act of an owner's agent contracting on her behalf, that no contract came into existence between an agent and purchaser and that the owner's giving a receipt for instalments on the purchase price was not ratification because she did not have full knowledge of all material circumstances: Bennett v Strauss [2016] FICR 31.
